Preparing For Your Appointment
Identification
The primary function of a Notary Public is to examine identification, that you are the person listed on the document and to act as an impartial witness, when you sign your documents. This is to deter fraudulent activity.
Options for ID
These should be unexpired or if expired, issued within 5 years prior to the expiration date:
Note: If you have an elderly parent with mobility issues, they often need to get documents notarized.
Seniors can apply for a "free" senior ID card (62 years and older) often by mail, you can review your options & find the CA DMV application.
Review Your Documents for Accuracy
Please be sure your document is filled out and if sections are not applicable, please indicate that on the document.
If your Lender, Escrow, Title or Attorney requires you to complete the document in the presence of a notary public, they will usually indicate this, in their instructions to you.

- It is a violation of California law for a Notary Public to notarize an incomplete document. This law is to protect the signer from someone fraudulently entering additional information on your document, after it is out of your possession.
- Please wait to sign your document until your appointment.

Although I receive many calls asking me to provide different types legal forms, according to the Secretary of State, this is considered an illegal practice of law.
Please consult an attorney if you have questions about the best option for you.
If you are looking for basic templates for documents such as permission to travel with minor child ect., you can find many types of fillable forms, by performing a Google search.

types of notarial acts
The individual or company requesting that your signature be notarized, will usually determine which notarial act is used.
A Notary Public may provide an Acknowledgement or Jurat, but cannot choose which notarial act is to be executed.
If your document does not have notarial verbiage attached, I recommend checking with the custodian of the document for their preference. All notarial acts require you to meet with the Notary and provide the state of California approved identification listed in the Options for ID section of this page.
The following is a brief description of both types of notarial acts:
Jurat:
This is a sworn statement and requires an oath or affirmation to complete this notarial act.
It must be signed in front of the Notary Public.
Acknowledgment:
It's always best to sign in Notary’s presence, although this type of notarial act can be signed prior to the appointment and acknowledged to the Notary Public that it is your signature on the document.
The signer is still required to appear before the Notary and to provide CA state approved identification, before the document can be notarized.
Again, it is always best to sign in front of the notary.

Commonly asked Questions about the Notarization Process
Q: What is a notary public?
A: A Notary Public is an official of integrity appointed by state government —typically by the secretary of state — to serve the public as an impartial witness in performing a variety of official fraud-deterrent acts related to the signing of important documents.
Q: Can I be refused a notarization?
A: A notary public may refuse to perform a notarization if he or she cannot be certain of a prospective signer’s identity, willingness, or understanding of what is happening at that moment. In addition, a notary may not notarize a document in which he or she has a financial interest.
Q: Can a notary certify a copy of a document?
A: State laws may vary, but in California, a Notary Public may only certify a copy of a Power of Attorney, no other document. For vital records documents such as birth certificates and marriage certificates, the requester should visit the local agency that holds these documents, such as a local county clerk.
Q: What about immigration paperwork...can a notary public prepare or notarize immigration papers?
A: A notary may notarize papers, those that require notarization as follows: A notary public may notarize the signature on a document affecting the immigration or citizenship status of any person; however, under current law, a notary public who is not also an immigration consultant cannot do the verification tasks in connection with completing immigration forms because this activity is prohibited by the broad language of California Government Code section 8223. Only an attorney, a representative accredited by the U.S. Department of Justice, or a person who is registered by the California Secretary of State and bonded as an immigration consultant under the California Business and Professions Code section 22441 may assist a client in completing immigration forms. This law also prohibits a notary from signing in a non-notary capacity on an I-9 form, according to the Secretary of State for California, unless the notary public is bonded as an immigration consultant.
